By accessing and using the website and services provided by Mighty Agri Export Pvt. Ltd. ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services. These terms constitute a legally binding agreement between you and the Company.

We reserve the right to modify, update, or replace any part of these Terms and Conditions at our sole discretion. Changes will be effective immediately upon posting to the website. Your continued use of the website following any changes constitutes acceptance of those changes. It is your responsibility to review these terms periodically.

Mighty Agri Export provides agricultural commodity export services including but not limited to the sourcing, processing, packaging, and international shipment of pulses, oilseeds, spices, edible oils, and related products. All product descriptions, specifications, and availability information provided on our website are subject to change without prior notice.

We strive to ensure that all information on our website is accurate and up-to-date. However, we do not warrant that the information is free from errors or omissions. Product images are for illustrative purposes only and actual products may vary slightly in appearance. We reserve the right to discontinue any product or service at any time without liability.

All orders are subject to acceptance by the Company. An order confirmation does not constitute a binding contract until we have reviewed and confirmed the order details, including pricing, quantity, and delivery timeline. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.

Payment terms are negotiated on a per-order basis and may include Letter of Credit (LC), Telegraphic Transfer (TT), or Documents against Payment (DP) terms. All prices are quoted in the agreed currency and are subject to change based on market conditions, currency fluctuations, and order volume unless otherwise specified in a formal purchase agreement.

Shipping terms (FOB, CIF, CFR, etc.) are agreed upon at the time of order confirmation. While we make every effort to meet estimated delivery schedules, delivery dates are approximate and not guaranteed. Delays may occur due to factors beyond our control, including but not limited to customs clearance, port congestion, weather conditions, or regulatory changes.

Risk of loss and title for goods pass to the buyer upon delivery to the carrier or as specified in the agreed Incoterms. The buyer is responsible for all import duties, taxes, customs clearance, and any other charges levied by the destination country. We provide necessary export documentation to facilitate smooth customs processing.

All products supplied by Mighty Agri Export comply with international quality standards and are processed in facilities certified under ISO 22000:2018, ISO 9001:2015, HACCP, FSSAI, and other applicable certifications. We conduct multi-stage quality inspection throughout the processing chain to ensure product consistency and safety.

In the event of any quality-related concern, the buyer must notify us in writing within 14 days of receiving the goods, providing photographic evidence and detailed description of the issue. We will investigate the matter and, if the claim is validated, offer appropriate remedies including replacement, credit note, or refund at our discretion.

To the maximum extent permitted by applicable law, Mighty Agri Export shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to the use of our website or services, regardless of the theory of liability.

Our total liability for any claim arising from or related to our products or services shall not exceed the purchase price of the specific product or service giving rise to the claim. This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

Before initiating any legal proceedings, the parties agree to attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days through negotiation, either party may pursue legal remedies as described above.
